Section 2. Products

Each product is presented on the website in the form of a description containing its main technical characteristics (capacity, use, composition, etc.). The photographs are as accurate as possible, but do not bind the Seller in any way. Section 3. Prices

Section 4. Order and payment terms

The Customer guarantees to the Seller that he has the necessary authorizations to use the means of payment he has chosen when placing his Order. The validation of the Order is subject to the validation of the bank payment center chosen by the Seller. In the event of the bank's refusal, the Order is not finalized and is cancelled. As part of the fight against fraud on the Internet, information relating to the Order and the means of payment of the Customer may be transmitted by the Seller to any third party for verification.

The Seller, in collaboration with the bank managing electronic payments, checks all Orders that have been validated on the Site. Thus, any Order that has a delivery address different from the Customer's billing address may be verified by the Seller. In this context, the Seller may be required to ask the Customer for information and documents necessary for the execution of the Order: proof of address of the Customer and/or of the person indicated for the delivery address, justification of the bank details of the Customer, etc These requests are made to the Customer by e-mail or by telephone.

The bank account attached to the method of payment used by the Customer will be debited from the finalization of the order made by the Customer on the Site. The Seller may suspend or cancel any Order and/or any delivery, whatever its nature and its state of execution, in the event of non-payment, total or partial, of any sum which would be due by the Customer or in the event of payment incident (hereinafter, together, "Incident"). In order to ensure the security, integrity and confidentiality of payments made via the Site, the details of Customers' bank cards are encrypted using the SSL (Secure Socket Layer) protocol during their transit via the Internet.

The information relating to the Customer's means of payment provided in the Order Form will be processed securely by the Seller's payment provider, the company Stripe, and the qonto Bank (and Paypal if applicable) in order to process and authorize payment for the Order and analyze a bank transaction and fight against credit card fraud.

The occurrence of an outstanding payment due to fraudulent use of a credit card may result in the registration of the details of the Order Form associated with this outstanding payment in a payment incident file implemented by Stripe. The confirmation of an order entails acceptance of these conditions of sale, the recognition of having perfect knowledge of them and the renunciation of availing oneself of its own conditions of purchase. Section 5. Retention of title

The RACK AND RIDE company retains full ownership of the products sold until full payment of the price, in principal, costs and taxes included.

Section 6. Delivery

Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. Deliveries are made by La Poste (Colissimo service), Mondial Relay or UPS, delivery service with or without tracking, delivery with or without signature. Delivery times are given for information only; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. The buyer is delivered to his home by his postman. In the absence of the buyer, he will receive a delivery notice from his postman, which allows him to withdraw the products ordered from the nearest post office, for a period indicated by the postal services. The risks associated with transport are the responsibility of the purchaser from the moment the items leave the premises of the company RACK AND RIDE. The buyer is required to check, in the presence of the La Poste employee or the deliverer, the condition of the packaging of the goods and their contents upon delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.

Section 7. Withdrawal

Right and period of withdrawal of the Customer for orders placed on the Site

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, except for return shipping costs.

RETURN

The postal costs incurred to return the products to the Seller are entirely borne by the Customer.

The Seller will make the refund using the same means of payment as the Customer used for the initial transaction.

The Seller will reimburse the Customer within three (2) to fifteen (15) days (delay variable depending on the bank), upon recovery of the goods by the Seller or upon justification by the Customer of the shipment of these goods, the date retained being that of the first of these facts.

The withdrawal of the Order by the Customer will only be effectively taken into account provided that the product for which reimbursement is requested by the Customer from the Seller has been sent to the Seller within the said fifteen (15) day period.

Section 8. Guarantee

The company RACK AND RIDE, in the process of distance selling, is bound only by an obligation of means. Its liability cannot be engaged for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.
